Regulation 4 of the Control of Asbestos (CAW) 2006
If you own, manage, occupy or have responsibilities for the premises you have a legal obligation to have your premises surveyed for Asbestos under Regulation 4 of the Control of Asbestos 2006 - it is your duty to manage Asbestos in your premises, not the landlord’s - yours as the occupier. Your Insurance company may also insist that you have your premises surveyed for asbestos.
The new legislation was brought in to do one thing: Preserve human life.
It is your duty to look after your staff and maintenance contractors. Make them aware of any Asbestos in your premises, Asbestos can be very dangerous when disturbed, it needs to be identified and registered so you can make others aware.

The penalties for non-compliance could be severe
- H.S.E inspectors have the power to issue prohibition notices closing your site.
- Companies can be fined an unlimited amount, and individuals £20,000.
- Responsible individuals can be imprisoned for up to 2years.
- Directors can be disqualified.
